Misdeclaration Penalty

Safety in cargo transportation is of paramount concern to WM. This being the case, we would like to have your attention on the importance of strictly and continuously complying with the requirements applicable under any laws, conventions, rules, or regulations in respect of, including but not limited to declaration, packaging, labelling, carriage, or handling of both General and Hazardous Cargo. Additionally, we would require all to honestly and accurately make declaration of Hazardous Cargo in accordance with the said requirements as well as the requirements made by us, the Ocean carrier and / or our agents prior to delivery of cargo to us at our designated depots/terminals.

In the event a cargo is misdeclared, WM will impose a Misdeclaration Penalty for your non- incompliance, non-declaration, or failure to honestly and accurately make declaration of Hazardous Cargo with effect from September 05th, 2024. The quantum of penalty will at least be the sums imposed by the Overlying Carrier and an additional sum of USD 10,000 (if a Overlying Carrier/Vessel owners were to impose a penalty for mis-declaration of USD 20,000, then the total penalty charged by us would be USD 30,000 (USD 20,000 + USD 10,000).

We would also like to remind you that any expense and or customs penalty which may incurred, including but not limited to inspection for such misdeclaration shall be on account of the cargo owner/Shipper or its agent/Booking party. The cargo owner/Shipper or its agent/Booking party shall further indemnity and hold WM harmless from and against all loss, damage, expense, actions and claims for injury to or death of persons and damage to property arising out of such misdeclaration, and we may, at our sole discretion, suspend or terminate the carriage of your cargo at any time and any place.
